I paid an advance for renting in aparment and now dont want to take that apartment?

Morris Cuomo: You owe the deposit. You can't stop the check. The deposit was to hold the place for you, they stopped trying to find a new tenant. He can sue you for the $500 plus his court costs. Pay him the money, you will lose this 100% of the time.

Donte Liversedge: You did the wrong thing by stopping the check. You should have informed the landlord and he should have given you your deposit back if you have not signed any sort of lease yet. Instead, you cut corners, and, he could feasibly sue you, but, I feel it would be more hassle to do that than to just move on and rent to someone else. Was this a non refundable deposit? Was any portion of it non refundable? Just keep your fingers crossed that they don't want the headache that goes with small claims and just moves on. If you signed the lease, he could sue you for the full amount or the time the apartment is empty while he is trying to rent it, whichever is less.The reason you broke the agreement doesn't matter. Jackson Esmiol: Well, he did take the apartment off the market based on your word that you would take it. That may have lost him another renter. I expect he can sue you for the amount of the advance. It really wasn't well done on your part to stop payment on the check.

Krystal Cordovano: Y! ou should not have stopped payment on the check. You agreed t! o take the apartment, that check is to cover the cost of saving the apartment for you. The landlord has lost other potential buys by stopping advertisement or telling them no because you agreed to rent it. Most likely some contract or paperwork should have been signed when you made your first payment - you need to go by the policies on that. If a contract was night signed, the landlord has proof of your check that you intended to take the apartment. I think if the landlord takes you to court, he will win. He can sue you for the $500 back, another $500 for no 30 day notice (usually what you give when you'd like to stop renting), court costs, lawyer fees, bank fees......Show more

Providencia Jalbert: Usually you come to some sort of written agreement before you begin any type of payment on a place. If you didn't work anything out then you are probably screwed.

Catheryn Small: i have not signedd any agreement or lease. I just gave advance to hold it and within 4 days I went back and told that I dont need your apartment. What I owe him, please tell me, is it the advance amount, 4 day or one week rent. Or I have to compensate him for the duration his apartment get rented again. I took only 4 days to confirm the things and everything was verbal
